The ability for SmartMLS to remotely access your computer may significantly enhance SmartMLSs ability to try and resolve technical problems quickly.  However, remote access services are provided by a SmartMLS representative at your request and at your sole risk.  As such, SmartMLS recommends that you remain at your desk and observe the entirely of the remote access support session.

By accepting the invitation from a SmartMLS representative, you are representing that you have received permission to share access and control of the computer, network or system with a SmartMLS representative, as well as authorizing SmartMLS to connect to your computer, system or network.  You understand that by requesting such assistance, you will be providing a SmartMLS representative with access to remotely view your computer.  Be sure to close any confidential or personal files that you may be working on before allowing remote access to your computer.  While access to your computer may be subject to confidentiality provisions between SmartMLS and our customer, SmartMLS does not assume and is not responsible for any liability for the linking and viewing of any desktop content, the operation of the remote-control software or any hardware performance.  You are solely responsible for limiting access to information during any remote access session that cannot be disclosed to SmartMLS.

You further agree to accept any and all responsibility and liability for any changes made or data transmitted during periods when you have granted a SmartMLS representative access to your computer.  SmartMLS SHALL HAVE NO LIABILITY FOR ANY CLAIMS OR DAMAGES RESULTING IN ANY WAY FROM YOUR USE OF THE REMOTE ACCESS SUPPORT SERVICES. SmartMLS AND ITS REPRESENTATIVES MAKE NO WARRANTIES OF ANY KIND WITH REGARD TO THE REMOTE ACCESS SUPPORT SERVICES PROVIDED HEREUNDER. SmartMLS AND REPRESENTATIVES HEREBY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE REMOTE ACCESS SUPPORT SERVICES INCLUDING WITHOUT LIMITATION ANY AND ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL SmartMLS OR ITS REPRESENTATIVES BE LIABLE FOR (i) ANY SPECIAL, DIRECT, INDIRECT OR CONSEQUENTIAL DAMAGES OR (ii) ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE PROVISION OF REMOTE ACCESS SUPPORT SERVICES.
