13. Dispute Resolution and Arbitration
Before initiating any legal action regarding this Privacy Statement or your use of the Sites, both you and SmartMLS agree to attempt in good faith to resolve the dispute through written notice and informal discussions.
If the dispute is not resolved within 30 days, either party may elect to submit it to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
Key Terms: Arbitration will occur on an individual basis only; class or representative actions are not permitted. The arbitration will take place in New Haven County, Connecticut, or virtually, at the arbitrator’s discretion. The arbitrator, not any court, will have exclusive authority to interpret and enforce this arbitration agreement, including any dispute over its scope or validity. Judgment on the arbitration award may be entered in any court with proper jurisdiction. By using our Sites, you waive the right to a trial by jury or to participate in a class action, to the fullest extent permitted by law. Nothing in this section prevents either party from seeking injunctive or equitable relief in state or federal court for unauthorized use, data breaches, or misuse of confidential information.
